The basic legal situation: 
A person under guardianship is known as a ward. The ward´s guardian or the court registrar must invest the assets of a ward in a manner eligible for trust investments. The investment of trust money is explicitly laid down in the “Bürgerliches Gesetzbuch” (BGB – German Civil Code). This specifies that the guardian shall invest the money safely so as to earn interest:
Section 1806 BGB and Section 1807 BGB


In addition to the trust investments explicitly named in the BGB, the open-ended real estate fund KanAm grundinvest Fonds has also been recognized as eligible for trust investments since the favorable ruling by the Munich Local Court of May 27, 2005, reference number 709 XVII 00189/98. Additional courts have since followed this opinion in their rulings. Investors can refer to these rulings if they would like to obtain the approval of the Guardianship Court in each case, as required by Section 1811 BGB.
